Terms of Service
Clear terms for using our site and booking our services.
These Terms & Conditions govern your use of The American Handyman Company website, communications, quotes, scheduling tools, and services. By using our website, requesting a quote, scheduling service, or hiring us for a project, you agree to these terms.
Website use
You agree to use our site lawfully, honestly, and without interfering with operations, security, or other users.
Service terms
Quotes, invoices, work orders, and written project communications are part of the agreement for any specific job.
Important limits
We work hard to communicate clearly and stand behind our work, but these terms also explain pricing changes, warranty limits, and liability boundaries.
1. Acceptance of These Terms
By accessing this website or using our services, you agree to be bound by these Terms & Conditions and any additional written terms that apply to a specific project, estimate, invoice, or service agreement.
If you do not agree with these terms, do not use the website or book services through us.
Eligibility
You must be legally able to enter into a binding agreement to use our services. If you are booking on behalf of a company, property owner, or other organization, you represent that you have authority to do so.
2. Website Use and Site Content
You may use our website for lawful business or personal purposes related to learning about our services, requesting quotes, scheduling work, or contacting us.
You agree not to:
- Use the site for unlawful, fraudulent, abusive, or misleading purposes
- Attempt to damage, disable, scrape, overload, reverse engineer, or interfere with site operations
- Attempt unauthorized access to accounts, admin tools, forms, or connected systems
- Upload or transmit malware, spam, or harmful code
- Copy, reproduce, or republish our site content, branding, graphics, or written materials without permission
All site content, unless otherwise noted, is owned by or licensed to The American Handyman Company and is protected by applicable intellectual property laws.
3. Quotes, Estimates, and Service Agreements
Quotes and estimates are based on the information available at the time they are prepared. This may include customer descriptions, photos, measurements, site conditions, and any assumptions reasonably made from the information provided.
- Quotes may be revised if site conditions, access, materials, labor requirements, or project scope differ from what was originally described
- Hidden damage, code issues, prior workmanship problems, or unsafe conditions may require additional work or a revised price
- Job-specific documents such as proposals, invoices, work orders, change approvals, text confirmations, or signed agreements control over this page if there is a direct conflict
Short version: estimates are prepared in good faith, but concealed conditions, prior repairs, site access, or material requirements may affect the final scope and cost.
4. Customer Responsibilities
To help us perform services safely and efficiently, you agree to:
- Provide accurate contact, property, access, and project information
- Disclose known hazards, defects, prior repairs, water intrusion, electrical issues, code concerns, pets, or access restrictions
- Ensure safe and reasonable access to the work area, including utilities and any necessary permissions
- Move or protect personal property, valuables, fragile items, and other belongings as reasonably needed before work begins
- Review and approve scope changes, pricing updates, or scheduling communications in a timely manner
We may pause, reschedule, or decline work if conditions are unsafe, materially different than described, or outside the scope we agreed to perform.
5. Scheduling, Access, and Cancellations
Appointment dates and arrival windows are estimates unless we expressly guarantee a specific time in writing. Delays may occur due to traffic, weather, prior jobs running long, material availability, safety concerns, or events outside our control.
- Please notify us promptly if you need to reschedule or cancel
- Late cancellations, no-shows, inaccessible sites, or repeated failed access attempts may result in trip charges, rescheduling fees, or delayed service
- If materials have been ordered, staged, fabricated, or specially sourced for your project, cancellation may be subject to non-refundable costs already incurred
6. Pricing, Payments, and Chargebacks
Prices, deposits, invoices, and payment timing may be stated in a quote, invoice, booking confirmation, or other written job communication.
- Payment may be due in full upon completion unless other written terms apply
- Deposits may be required for scheduling, large projects, special-order materials, or reserved labor time
- Past-due balances may be subject to collection activity, late fees where permitted, or suspension of future service
- If a pricing, clerical, or system error occurs, we may correct it and contact you before proceeding
If you believe a charge is incorrect, contact us first so we have a chance to fix it. Filing a chargeback before contacting us may delay resolution and may leave non-refundable processing costs unresolved.
7. Materials, Substitutions, and Change Orders
Some projects require customer-supplied materials, company-supplied materials, or a combination of both. Unless otherwise stated:
- Material availability can affect scheduling and final timing
- Reasonable substitutions may be proposed when specified materials are unavailable or impractical
- Additional work requested after a job begins may require a revised quote, added labor charges, or rescheduling
- We are not responsible for manufacturer defects, discontinued products, or delays caused by suppliers or shipping carriers
8. Warranty, Disclaimers, and Limitation of Liability
Any workmanship warranty we provide is limited to the scope and time period stated in writing, if any. Manufacturer warranties on materials or products belong to their respective manufacturers unless expressly stated otherwise.
What we do not guarantee
- Conditions outside the agreed scope of work
- Pre-existing defects, hidden damage, structural issues, code violations, or failures in unrelated systems
- Wear and tear, misuse, abuse, neglect, lack of maintenance, or customer-supplied materials that fail
- Color, finish, texture, or exact-match differences that are commercially reasonable or unavoidable
Liability limit
To the fullest extent permitted by law, our total liability for any claim arising out of or related to our website or services will not exceed the amount you paid for the specific services giving rise to the claim. We will not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, loss of use, business interruption, or damage caused by conditions outside the scope we were hired to address.
9. Indemnity, Governing Law, and Disputes
You agree to indemnify and hold harmless The American Handyman Company from claims, damages, losses, or expenses arising from your misuse of the website, your breach of these terms, inaccurate information you provide, unsafe site conditions you failed to disclose, or your violation of applicable law.
These Terms & Conditions are governed by the laws of the State of Florida, without regard to conflict-of-laws rules, unless another law is required to apply. Any dispute arising from these terms or our services will be handled in the appropriate courts located in the applicable Florida jurisdiction unless both parties agree otherwise in writing.
10. Privacy and Electronic Communications
Your use of the website is also subject to our Privacy Policy. By contacting us electronically or using our site, you consent to receive communications from us electronically, including email, text messages where applicable, scheduling updates, invoices, receipts, and service-related notices.
11. Changes to These Terms
We may update these Terms & Conditions from time to time. When we do, we will revise the “Last Updated” date on this page. Continued use of the website or our services after changes are posted means the updated terms will apply going forward.
Questions about a quote, invoice, or service term?
If you need clarification on how these Terms & Conditions apply to a specific job, reach out before the issue becomes harder to resolve. We would rather clarify expectations early so the project, invoice, or service terms stay understandable.
